J.F. Lehman & Company (JFLCO), a middle-market private equity firm said that its investment affiliate JFL-NRC-SES Partners, LLC  signed an agreement to sell its membership interests in NRC Group Holdings, LLC (NRC Group), formed earlier this year with the combination of JFLCO companies National Response Corporation (NRC) and Sprint Energy Services (Sprint) , to Hennessy Capital Acquisition Corp. III (HCAC). After the transaction is completed, NRC Group will be a wholly-owned direct subsidiary of HCAC, who will change its name to NRC Group Holdings Corp. NRC Group Holdings Corp.

Lately, I have been reading reports regarding the United States Coast Guard’s (USCG) escalating enforcement of ballast water discharge violations. In the first case, the USCG initiated a civil penalty proceeding against a bulk carrier for discharging ballast water in Washington State without using a USCG Type Approved Ballast Water Management System (BWMS) or other approved means. The USCG proposed the maximum penalty of $38,175. In a more recent case, the USCG issued a $5,000 fine for a similar unauthorized ballast water discharge in Oregon.

Ballast water treatment systems manufacturer Ecochlor, Inc. has named Steve Candito as its new CEO, effective August 8, 2017. Candito succeeds retiring CEO, Charlie Miller, who will assist during the transition. The Coast Guard is monitoring the transit of a motor vessel that ran aground in the Columbia River near Skamokawa, Washington, but was refloated, inspected and given a captain of the port order to transit to Kalama, Saturday morning. There was no report of pollution or injuries stemming from the grounding of the Nenita, a 738-foot Marshall Islands-flagged bulk carrier fully laden with grain. Watchstanders at the Coast Guard Sector Columbia River were notified of the incident at 3:21 a.m. The vessel was headed outbound the Columbia River from Kalama, Washington when the vessel reportedly lost propulsion and ran hard aground and was taking on water. The vessel’s crew found, isolated and secured the flooding in the forward peak of the vessel.

The U.S. Coast Guard is investigating a report of an oil spill in the Los Angeles Harbor, Thursday morning. Watchstanders at Coast Guard Sector Los Angeles/Long Beach command center received a report at 10:48 a.m. of an unknown quantity of oily-water mixture coming from a holding tank residing on the Vopak Terminal. Coast Guard investigators from Sector Los Angeles/Long Beach are currently investigating the report. A majority of the oil released has been reported as being contained on the pier, however, some of the oil water mixture entered the water. Oil spill response organizations including the National Response Corporation, Ocean Blue, and Patriot Environmental are conducting clean-up operations using oil skimmers and absorbent pads.

A Unified Command consisting of the U.S. Coast Guard, operators of the motor vessel Sparna, Columbia River Pilots and the National Response Corporation Environmental Services oversaw the safe transit of the damaged motor vessel Sparna up the Columbia River to the North Kalama, Washington pier, Wednesday afternoon. The Sparna, a 623-foot Panamanian-flagged grain bulk carrier, started the transit from its anchorage near river marker 36 with the assistance of two tugs and a Coast Guard safety zone escort at about 12:30 p.m., and moored at the Kalama North pier at about 6 p.m.

The Coast Guard and California Fish and Wildlife’s Office of Spill Prevention and Response are continuing their investigation of an oil spill that occurred on Sunday in the Los Angeles Harbor. A unified command has been established that includes the Coast Guard, California Fish and Wildlife, and the responsible party. Coast Guard Sector Los Angeles-Long Beach command center received a report at 6:30 p.m., Sunday, of an unknown quantity of oil in the vicinity of the 577-foot cargo ship, Istra Ace. The ship was reported to have been leaking heavy fuel in the Cerritos channel at Berth 198. Oil was also observed throughout portions of Cerritos Channel, where booming strategies have been employed.

As the Voice of Spill Response Professionals, the Spill Control Association of America (SCAA) is supporting and assisting with the planning and coordination of IOSC 2014 on May 5-8 in Savannah, Ga. SCAA encouraged all members to attend IOSC, submit technical papers, volunteer as technical paper review team members and demonstrate equipment technologies. Long awaited, much hyped, the new rules require compliance in January. Will industry and more importantly, the response community, be ready? In September, the U.S. Coast Guard published the long awaited Non-tank Vessel Response Plan (NTVRP) and Other Response Plan regulations. The U.S. Coast Guard cites “Improved preparedness and reaction to an incident, including a worst case discharge, and improved effectiveness of shore-side and onboard response activities” as the primary benefits of the new rule. For all affected vessels, a mandatory compliance date of January 30, 2014 looms large the porthole. The regulations impact self-propelled non-tank vessels of 400 gross tons or greater that operate in navigable waters of the United States and carry any kind of oil as fuel for main propulsion.

Washington State – Alaska – Non tank final rule & Washington State – Contingency Plan requirements. We refer to our circular no. B.613. As stated in that circular, every tank vessel and every other vessel over 300 GT is required under State law to file a contingency plan prior to entry into the waters of Washington State but that instead of filing his own plan an owner can subscribe to an umbrella oil spill contingency plan. Since publishing the abovementioned circular, Washington State Maritime Co-operative (WSMC) has changed its enrolment agreement and the version with footer “WSMC Enrolment Agreement – December 2013” conforms with the International Group’s guidelines on vessel response plans.
