The U.S. Coast Guard announced Friday Rear Adm. Melissa Bert has been invested as judge advocate general and chief counsel of the Coast Guard. An allision in the maritime sector is defined as an accident in which a moving object strikes a stationary object (bridge fender, bridge deck, dock, dredging vessel, etc.). According to the Maritime Law Association (MLA) such an accident calls the “Oregon Rule” into play. Simply put, the Oregon Rule states that “…when a moving object hits a stationary object, the moving object is presumed at fault. The moving vessel thus has the burden of proving an alternate theory of causation…

BIMCO’s Documentary Committee approved a new set of standard bunker terms, developed by a cross-industry group, in New York on 2 May. The BIMCO Bunker Terms 2018 improve on the previous edition with a maximum limit of the parties’ liabilities – a key change that will lead to wider adoption of the contract. “I think it is a positive step for the industry that representatives for the bunker traders and shipowners have agreed on a standard set of terms, which both parties consider fair and balanced,” says Francis Sarre, Chair of the BIMCO Documentary Committee. The trader representatives who helped draft the contract together account for 25% of the total bunker volume sold globally, which BIMCO sees as a very strong sign of support for the final result.

Robert (Bob) Clyne, ABS Senior Vice President, General Counsel and Corporate Secretary , was recognized with the Outstanding Professional Achievement Award for his distinguished accomplishments as a graduate who best exemplifies the finest tradition of Kings Point – Acta Non Verba – and lending honor and prestige to the United States Merchant Marine Academy. “Bob is most deserving of this recognition,” said ABS Chairman, President and Chief Executive Officer Christopher J. Wiernicki. Clyne began his career at ABS working in various positions from 1982 to 1988. Upon earning his law degree, he joined the firm of Hill Rivkins LLP where he practiced maritime law for 24 years and served as Co-Managing Partner from 2006 to 2012.

The North American Marine Environment Protection Association (NAMEPA) announced that Clay Maitland will receive the organization’s Lifetime Achievement Award at an awards dinner in New York on October 26. Maitland, who is a Managing Partner of International Registries, Inc (Marshall Islands Ship Registry), is being recognized for his many industry accomplishments including being a NAMEPA co-founder. “Clay is one of the finest examples in our industry of a successful businessman who expends nearly as much energy on philanthropy,” said NAMEPA Chairman Joe Hughes. Maitland has worked in the shipping industry since graduation from law school in 1968. He was employed by International Registries, Inc.

Unmanned aerial systems (UAS), or “drones” in common parlance, are not a part of the historical maritime vocabulary. At least not yet. While the term “drones” may conjure images from science fiction, the reality is that companies are designing commercial UAS for the private sector, and they are gradually permeating our daily life. Harry Diamond, Vice President and Chief Claims Officer at WQIS, is celebrating 21 years with the company this year. Diamond is a graduate of LaSalle University with Bachelor of Arts degrees in social studies education and history; he also holds an Associate degree in Risk Management. He began his insurance career right out of college when he was hired by a brokerage firm whose main client was Keystone Shipping Company. Diamond continued with the firm for four years until he changed his career path because of “an itch that needed to be scratched” – his desire to be a teacher. For the next six years, Diamond taught eighth grade at St. Mary’s Interparochial School in the Society Hill area of Philadelphia, Pennsylvania.

The need to regulate and police the maritime domain to tackle global threats is as pressing as ever, according to Phil Cable, CEO and cofounder of maritime security company MAST. “The global threats faced by the maritime environment, whether it be terrorist, pirate, illegal fishing, human trafficking or narcotics smuggling, stem from lack of law and order,” Cable stated, speaking at the Maritime Law Association of Australia and New Zealand (MLAANZ) Conference 2015 in Perth, Australia, Thursday. “The reason for this is that many states lack the organization, finance or will to police and manage their territorial waters or economic zone, or they are, like Yemen, Libya, or Somalia failed or near failed states thus creating a permissive environment for criminality,” Cable said.

On November 13, the newly formed New York Maritime Consortium, a coalition of leaders from New York Maritime Inc. (NYMAR), the Society of Maritime Arbitrators (SMA), the Maritime Law Association (MLA) and the Association of Shipbrokers and Agents (ASBA), will host an event entitled “New York and London: Perception and Reality”. According to the event’s organizers, key industry figures from the areas of finance, arbitration and law from both sides of the Atlantic have been invited to illustrate the strengths of each jurisdiction, and how the two relate to each other. Chief Judge Loretta Preska of the Southern District of New York Federal Court will moderate the event. The forum will be held from 2:30-6 p.m. at The Harvard Club.

The Liberian International Ship & Corporate Registry (LISCR), a member of the YCF Group of companies and exclusive administrator of the world’s largest quality ship register, has appointed Christian Mollitor to the position of vice president. This newly created role represents a return to LISCR for Mollitor. A.M. Best Co. has released the latest installment of the Insurance Law Podcast , a series that examines timely insurance issues from an attorney’s point of view. This episode features attorney David Skeen of the firm Wright, Constable & Skeen, LLP in Baltimore, Maryland. Mr. Skeen has been practicing admiralty law for 39 years and has been an editor with the publication American Maritime Cases for most of that time. He is a member of the Maritime Law Association of the United States and has written and lectured on various aspects of maritime law. Mr. Skeen discusses the decision of the Supreme Court of the United States in the case of Lozman v. City of Riviera Beach, Florida to hold that a houseboat previously considered a vessel under maritime law was not a vessel.

This is a good time to look aft and reflect on the accomplishments achieved in 2012, as well as to the distant horizon to see what challenges loom in 2013, and beyond. It is fair to say that the Coast Guard and salvage industry have come a long way in the last few years with implementation of a salvage and firefighting final rule; first published in December 2008, delayed until February 22, 2011, to provide for harmonization with the changes to the vessel and facility amendments for response plans.
