MARAD Announces Initiatives to Support Cargo Preference Compliance

Last week during testimony before the Subcommittee on Coast Guard and Maritime Transportation, MARAD Administrator Ann Phillips (Rear Admiral, USN, Ret.) announced two efforts intended to support federal compliance with cargo preference requirements. Administrator Phillips announced that MARAD will issue a Request for Information to solicit input from all stakeholders on cargo preference requirements. Administrator Phillips also announced that MARAD will resume publishing comprehensive federal cargo preference data.

Subchapter M Phase-in Period Draws to a Close

The U.S. Coast Guard on Tuesday marked the end of the four-year Subchapter M certificate of inspection (COI) phase-in period for U.S.-registered towing vessels. Subchapter M, the United States regulatory code dealing with towing vessels and requirements for towing vessel safety, has officially been in place since July 2016, when the U.S. Coast Guard finalized the long-awaited Sub M rulemaking. National Transportation Safety Board Chair Jennifer Homendy on Friday praised the House of Representatives for passing a Coast Guard reauthorization bill that includes policies to improve the safety of amphibious vessels known as DUKW boats and holds the Coast Guard accountable to NTSB safety recommendations.DUKW boats, also known as duck boats, were designed and built in the 1940s for military use during World War II; some were later converted for commercial service. They are unique vessels with special challenges that must be addressed to ensure passenger safety.

Biden Administration Names Lessley as MARAD Deputy Administrator

Lucinda Lessley has been named Deputy Administrator of the U.S. Maritime Administration (MARAD), the Biden Administration announced Thursday among a number of key appointments to its Department of Transportation (DOT) leadership team.Lessley will lead MARAD until an Administrator is nominated by the Biden Administration and confirmed by the Senate. She takes over from Doug Burnett, MARAD's Chief Counsel, who had been serving as Acting Administrator following Mark Buzby's resignation in the wake of the Capitol intrusion earlier this month.

US Defense Bill Affirms Jones Act Applies to Offshore Wind

The U.S. Senate on Friday passed the National Defense Authorization Act (NDAA) for fiscal year 2021, a massive $741 billion defense bill setting policy for the Pentagon. Importantly for the U.S. offshore and maritime industries, the bill includes an amendment ensuring full enforcement of the Jones Act and other federal laws in offshore wind development.The legislation passed the Senate by a vote of 84-13 and now heads to President Donald Trump’s desk for his signature following overwhelming 335-78 veto-proof House passage on December 8.

The President says he wants to make American great again, so why is he trying to destroy the principal support system for America’s maritime industry? This week, we learned that President Trump is “seriously considering” issuing a broad waiver for the Jones Act, a critical law that requires domestic shipping in the U.S. to occur on ships that are built in the United States, fly the U.S. flag, and are operated by crews consisting of at least 75 percent American citizens.I served as the top Democrat on the House Subcommittee of Coast Guard and Maritime Transportation for six years.
