Subchapter M: Top 5 Moves to Make Now

In 2004 Congress reclassified towing vessels as vessels subject to inspection. Thus began a lengthy process of regulation drafting by the U.S. Coast Guard, with a great deal of input from the towing industry. In 2011, the Notice of Proposed Rule Making was published giving the public its first look at what has become known as Subchapter M. Over 3,000 comments were received by the Coast Guard on the Proposed Rule. After five years of responding to those comments and revamping Subchapter M, on June 20, 2016 the Final Rule was published.

The advent of the subchapter M towboat rules – even though the bulk of the rules don’t come into effect until July of 2018 – requires a close look at your equipment. How you go about that important task will make all the difference. Towing vessels should be surveyed for Subchapter M regulatory compliance, regardless of the compliance option chosen, so companies can budget and plan for upgrades between now and July of 2018. If a company is being proactive and strategic about Subchapter M, the time to start getting vessels surveyed for regulatory compliance is now.

ChartCo Acquires Docmap

ChartCo, provider of maritime digital data and compliance services, said it has expanded its range of integrated marine solutions with the acquisition of the at-sea digital document management company Docmap. Oslo-based Docmap AS was founded in 2005 and provides solutions within the health, safety, environmental and quality (HSEQ) operations on vessels and ashore. Its recently launched Docmap 8 software operates both shore side and on board through standard web browsers and incorporates modules for audit control and risk assessment, and works alongside customers’ continuous improvement programs. Helikon Expands Use of GNS Voyager

Maritime services group Global Navigation Solutions (GNS) announced that London-based bulk carrier operator Helikon Shipping Enterprises has expanded its use of its VOYAGER software solution across its fleet to take advantage of VOYAGER’s advanced route planning and optimization tools. Helikon, a customer of GNS for more than a decade, has extended its contract to make use of the navigational efficiency tools available within the VOYAGER solution. In addition to VOYAGER’s inventory management, compliance management and chart updating functionality, the fleet is now also using A2BviaC digital distance tables and Meteo Group’s SPOS weather routing technology, all of which is enabling Helikon to improve route planning and achieve greater fuel efficiencies.

DHL Expects Immunity in Price Fixing Investigation

Deutsche Post expects its DHL forwarding business to be granted immunity from prosecution and fines by Singapore antitrust authorities, who are investigating 11 companies for alleged price fixing, the German logistics company said. The Competition Commission of Singapore (CCS) said this month it was investigating 11 freight forwarding companies, including Deutsche Post unit DHL Global Forwarding, for alleged price-fixing of air freight forwarding services. Deutsche Post told Reuters last week that the probe related to pricing and surcharges in the forwarding industry from 2002 to 2007. Forwarders buy cargo space from airlines, shippers and truckers and bundle shipments for customers, such as carmakers, high-tech firms and agriculture firms.

(Sub) Chapter M Finally Surfaces

For inland operators, Compliance, Safety & Technology make for heavy river traffic as software providers descend on a rapidly approaching, potentially lucrative niche market. Is there a panacea for subchapter M? Pending USCG Subchapter “M” (SubM) regulations will eventually require towing operators to implement safety standards and use safety management systems, or alternatively, allow for an annual Coast Guard inspection regime. The new rules are expected to allow towing vessel organizations to customize their approach to meeting the requirements, while providing oversight using audits, inspections, and reviews of safety data. As many as 5,000 vessels and their operators will eventually feel the impact of the so-called subchapter M rules.

Emsys Monitoring Technology for Emissions Regs

Hefty fines, detention and possible arrest are looming for ship owners/operators who fail to meet new ship emissions requirements. In accordance with MARPOL (Marine Pollution) Annex VI regulations, new Emissions Control Area (ECA) regulations for sea areas within 200 nautical miles from the coasts and ports of the U.S. and Canada go into effect on August 1, 2011. Even with an exemption clause that extends the regulations enforcement date to Aug. 1, 2012, the time window is short for outfitting thousands of vessels.

EU Project Aims to Improve Efficiency of Maritime Regulations

A new three-year European Research Project, partly funded by the EU has been launched to help increase efficiencies in regulation compliance and enforcement for the maritime sector. e-Compliance will facilitate tighter integration and cooperation in the fragmented field of regulatory compliance. It will closely align with the EU e-Maritime initiative of which a key priority is supporting authorities and shipping operators to collaborate electronically in regulatory information management. The maritime sector is, by necessity, heavily regulated.
