Two Ocean Shipping Companies to Pay $3.4M

Sea Star Line LLC and Horizon Lines LLC have agreed to resolve allegations that they violated the False Claims Act by fixing the price of government cargo transportation contracts between the continental United States and Puerto Rico, the Department of Justice announced today. Regulation shapes the workboat industry perhaps more than any other single factor. This regulatory seascape includes a myriad of onerous and ever-changing rules. A ‘SITREP’ on those choppy waters is therefore in order. Last December, the Coast Guard closed the public comment period following its Notice of Proposed Rulemaking (NPRM) requiring nearly all towing vessels to obtain Certificates of Inspection under Subchapter M of CFR 46. Ship Finance Terminates Charters With Horizon

Ship Finance International Limited (NYSE:SFL) has agreed to terminate chartering agreements with Horizon Lines, LLC relating to five of its vessels. Ship Finance will receive as termination compensation $40 million in second lien notes issued by Horizon Lines and warrants exercisable into ten percent of the common stock of Horizon Lines, Inc. as part of the restructuring outlined below. The 2,824teu vessels were built in Korea in 2006 and 2007, and have been chartered to Horizon Lines for an average of approximately 5 years. The original bareboat charter term was for 12 years, but following the termination of the Horizon Lines charters, Ship Finance will employ the vessels in the time-charter market instead.

U.S. DOJ: Guilty Plea in Oil Pollution Case

U.S. Shipping Company Convicted For Oil Pollution On High Seas. Horizon Lines, LLC was sentenced Tuesday in front of the Honorable Richard Seeborg after pleading guilty to felony charges concerning violations of international and national oil pollution laws that occurred on a large container ship called the S/S Horizon Enterprise, United States Attorney Melinda Haag announced. As part of a plea agreement, the company was ordered to pay $1,500,000, with $500,000 of the monies going to environmental projects in the San Francisco Bay area. Horizon Lines pled guilty to two counts of making false statements based on their knowing failure to maintain an accurate Oil Record Book in which all transfers and discharges of oil and oily waste are required to be recorded.

Sea Star Line Expands Puerto Rico Service

Sea Star Line, LLC has announced that they are adding the Port of Philadelphia to its rotation.  Sea Star Line vessels will service the port weekly, making calls to the Tioga Marine Terminal each Friday beginning, April 23, 2010. This will replace the current agreement with Horizon Lines, LLC, however cargo will still be accepted in Elizabeth, N.J. Sea Star Line vessels are configured for both Lo/Lo and Ro/Ro service. In addition to flexibly designed container and trailer space, they feature a garage area that accommodates oversized cargo, and another garage dedicated to automobiles.

Triton Shield Anti-Piracy System

Recently, International Maritime Security Network, LLC conducted their first phase testing of the originally designed, non-lethal Triton Shield Anti-Piracy System (APS). Horizon Lines, LLC, a US flagged container ship operator serving US domestic routes and Asia, offered their resources and assets to the project. Aboard the container vessel HORIZON CRUSADER, IMSN conducted APS system tests and safety drills with Horizon crew members. Both IMSN and Horizon Lines remain proactive in helping to search for a security solution for not only their own personnel but for everyone throughout the entire maritime industry. Porter Recognized with Impact Award

The University of North Florida (UNF) Transportation & Logistics (T&L) Flagship Program recognized Tami Porter, Director, East Coast & Gulf Terminal Operations of Horizon Lines, LLC, as the recipient of the Impact Award for Community Partner. Ms. Porter was presented the honor at an awards ceremony on May 1 in Jacksonville, FL. Porter was recognized for her contributions to the UNF T&L Flagship Program, including her work evaluating industry case competitions and participating in panel discussions for students. She also arranged port and vessel tours at Jaxport and provided guidance and expertise for the 130 students involved in the program, according to Lynn Brown, Associate Director of UNF's T&L Flagship Program.

Horizon Helps Deliver Concrete Canoes

Engineering students from 12 universities around the country will began competing in Hawaii in the conference finals of the American Society of Civil Engineers' 22nd Annual ASCE National Concrete Canoe Competition. The winner of these races will earn a spot in the national championships in North Carolina this June. Before the concrete canoes could begin their sail to the finish line, however, they had to get to the starting line. Working together, Horizon Lines, LLC, and Horizon Logistics, LLC, coordinated the door-to-door delivery of the competition canoes from inland points in the continental United States to the Port of Los Angeles for ocean voyage aboard a Horizon Lines container vessel to Honolulu and on to final destination at the University of Hawaii.

Horizon Makes $7.5m Debt Payment

Horizon Lines, Inc. (NYSE: HRZ), announced that it has made another voluntary debt reduction payment of $7.5m on its revolving credit facility. The payment is the third made by Horizon Lines in its fiscal fourth quarter and brings the total voluntary debt reduction to $17.5m for the quarter and to $40m since the second quarter. The principal payment reduces borrowings on its $250m revolving credit facility to $140m, and total debt outstanding to $590.5m. “Cash flow in the fourth quarter remains strong, even more so than we expected, and as a result we are repaying another $7.5m of debt today, which is more than we previously planned,” said Mike Avara, Senior Vice President and Chief Financial Officer.

Horizon Restructuring Plan

Horizon Lines, Inc. (NYSE: HRZ) announced a non-union workforce restructuring initiative targeted at reducing annualized labor-related costs by an estimated $7m to $10m. The company intends to reduce its workforce by at least 10%, or approximately 70 of its 700-plus non-union employees. Initially, the company will offer a voluntary severance program to certain eligible non-union employees. If the company is unable to achieve anticipated reductions from the voluntary program, it intends to implement an involuntary severance program for non-union employees. The company expects to complete the workforce reduction initiative by January 31, 2009, and it is expected to result in a fourth-quarter 2008 charge of approximately $3.5m to $5m pretax, or $0.11 to $0.16 per fully diluted share.

K-Sea Operating Partners L.P. of Staten Island, NY, has received approval to sell and transfer to Candian registry and flag of the tank barge KTC -135. Horizon Lines of Guam to Begin Micronesia Service

Horizon Lines, LLC initiated a new service to the Federated States of Micronesia and the Republic of Palau under the carrier's subsidiary company, Horizon Lines of Guam, LLC. The new service starts January 15th. Horizon Lines of Guam offers through bills of lading for service between Chuuk, Pohnpei, Kosrae, Yap and Palau and the United States. Horizon Lines Inc., a container shipping and integrated logistic company, on Friday said its board of directors voted to appoint current President and Chief Executive Charles "Chuck" G. Raymond as the company's first chairman. Raymond will retain his current responsibilities.
