Structural Safeguards in Coast Guard Suspension and Revocation Proceedings

Chief Judge Brudzinski has been an Administrative Law Judge with the U.S. Coast Guard since 2003 and its Chief Administrative Law Judge since 2013.  He has lectured extensively and has authored many articles on Coast Guard suspension and revocation proceedings for MarineLink publications, among others. The opinions expressed in this article are the author’s alone and do not necessarily reflect the official policy of the U.S. Coast Guard

This article examines 10 structural safeguards in Coast Guard Suspension and Revocation (S&R) Proceedings that ensure Coast Guard Administrative Law Judge (ALJ) decisional independence. These safeguards separate potential agency influences from the ALJ decision making process and are critical to mariner due process and fundamental fairness. We will start with an overview of Coast Guard S&R proceedings, followed by brief discussions of the Administrative Procedure Act, Administrative Law Judges, and U.S. Office of Personnel Management oversight.

HMAS Darwin Farewells the West

The call of 'last line!' meant a little more than normal as HMAS Darwin slipped from the wharf at Fleet Base West and set sail for Sydney recently. It signalled the end of the warship's long association with the west coast of Australia, unlikely to return before she decommissions at the end of the year. The Adelaide class frigate called Western Australia home for almost 13 years from 18 December 1993, before being relocated to Fleet Base East on 21 April 2006. Darwin's Maritime Logistics Officer, Lieutenant Commander Chris Duke, served aboard the warship during the change of home port and the final visit to Fleet Base West. "This is the third time I have been posted to Darwin. In 1993 I was an Able Seaman Writer, conducting personnel management and administration functions," he said.

Taylor to head Trojan Battery's Global Workforce

During the weeks of July 18-21, and August 1-4, Bouchard Transportation Co., Inc. partnered with SUNY Maritime College and privately hosted the required USCG Leadership & Managerial Skills Course at Bouchard’s corporate headquarters in Melville, N.Y. for all Bouchard tug captains and chief engineers. Bouchard is the first operator to privately host this class for their vessel employees. Effective March 24, 2014, additional training and/or assessments became required for certain Standards of Training, Certification, and Watchkeeping (STCW) endorsements.

Sub M 90 Program Underway

MarineCFO Offers Vessel365 & Homeport365. Industry technology services provider, MarineCFO, has announced the “Sub M 90” Program commencing February 25, 2016 and terminating June 22, 2016. According to Tug & Barge Solutions, a Sub M consultant and MarineCFO partner, the Office of Management & Budget (OMB) received the Final Rule version of Sub Chapter M from United States Coast Guard on February 12, 2016. The OMB has until June 22nd to review the Sub Chapter M Final Rule prior to publication in the Federal Register. The MarineCFO “Sub M 90” Program kicked off on February 25, 2016 to support towing operators during this OMB review process. NYK Recognised Again as "Nadeshiko Brand"

Vice Adm. Brown Confirmed as NOAA Deputy Administrator

Retired Coast Guard Vice Adm. Manson Brown was appointed by President Obama and confirmed by a voice vote of the U.S. Senate to serve as assistant secretary of commerce for environmental observation and prediction and deputy administrator for NOAA. Brown joins NOAA after 36 years of service in the U.S. Coast Guard. As deputy administrator, Brown will play a major role driving the Obama administration and NOAA priorities for weather and water services, climate science, plus the agency’s integrated mapping and Earth-observing capabilities.

Novoship tankship 'NS Columbus' the first Sovcomflot Group vessel to receive an IMO 2006 Maritime Labour Convention certificate. The Aframax crude oil tanker NS Columbus underwent an inspection by the Maritime Authority and was declared to be in full compliance with the regulations of the convention. The document granted will be valid until 20 February, 2018. This certificate confirms that the company-operator follows best practices in the observance of sailors’ rights, the provision of proper living and working conditions, and the granting of social safeguards.

Romar Award Frontier £650,000 for Personnel Management

Aberdeenshire-based oilfield service company Romar International has awarded the contract of the management of its offshore workforce to Frontier International, an Aberdeen based international oil and gas recruitment company. The personnel management contract, worth £650,000 in year one will require Frontier International to provide the management and logistics for up to 35 offshore operational personnel to support Romar’s North Sea and international operations. Positions include offshore supervisors and operators for the Romar swarf handling systems.

Duty of Care

Data collection and monitoring helps measure the impact exposure of Workboat crew and passengers. Professional powerboat users face an increased risk from injuries associated with the constant impacts they receive during their daily activities. It is not hard to imagine that constantly driving a rigid hull through a choppy sea will result in some uncomfortable moments, but much of the professional marine industry continues to pretend that there is no problem.
