When is a Master Entitled to Refuse Damaged Cargo? A Reminder from the Standard Club

A master’s authority to clause bills of lading issued by or on his behalf can sometimes become the cause of disagreement between shippers, charterers and carriers. Under Article III Rule 3 of the Hague/Hague Visby Rules after receiving the cargo, and on the demand of the shipper, the master is obliged to issue a bill of lading evidencing the quantity and apparent order and condition of goods to be carried. The buyer of cargo, the consignee in an international trade, will want the subject bill of lading to be  accurate and contain unambiguous remarks as to the quantity, quality and condition of the said cargo – so he knows exactly what he is purchasing.

Divorce Costs Could Sour Scotland's North Sea Hopes

Scottish nationalists are betting $2.5 trillion of hydrocarbons trapped miles beneath the North Sea could bankroll an independent Scotland, but winning control of the European Union's largest oil reserves would be no blank cheque. Scotland says the bulk of Britain's North Sea oil and gas reserves are in its waters, while London says any division would be subject to negotiations should Scots vote to end their 307-year-old union with England in a referendum on Sept. 18. Oil is the punch in Scottish First Minister Alex Salmond's pitch for independence: he accuses London of squandering the North Sea's mineral wealth and says Scotland would be one of the world's richest countries if it took control of its own destiny.

Aberdeen-based oilfield services firm Coretrax Technology Limited has secured over £1.2million of contracts since the start of the year and expanded its team to 12 people. Coretrax specialises in innovative oilfield services to the completion, cementing, abandonment and wellbore clean up sectors both in the North Sea and globally. MOL Bulker Bright Century Sinks

Mitsui O.S.K. Lines, Ltd. reported that the MOL-owned bulker Bright Century collided with a freighter in foggy conditions while under way on the high seas approximately 23 miles east of the Shangdong Peninsula (37°38”N 123°07”E), China. It sank some 40 minutes later, on May 2, 2010, at around 5:30 a.m. local time (GMT+8 hours). The crew of 23 (all Indians) was rescued by another vessel steaming nearby. The vessel with which Bright Century collided was the Liberia-registered Sea Success. That vessel’s crew was rescued by helicopter and all are safe. It has been reported that the Sea Success is now docked. The Bright Century left Dampier, Australia, with about 170,000 tons of iron ore bound for the port of Bayuquan, Liaoning Province.

Three Tankers Purchased

Unknown Italian buyers recently purchased three 1979 Japanese-built tankers for a total of $5.9 million. The vessels acquired by the Italians were the Sarpindo Palapa (16,370-dwt), the Sarpindo Primuda (16,319-dwt) and the Sarpindo Pribumi (16,291-dwt). Another tanker sold was the 1986 German-built Leng (10,628-dwt) purchased by unidentified Danish buyers for $11.9 million. Unknown buyers purchased four Japanese-constructed bulk carriers for a total of $32 million. The vessels were the Ma Guan Hai (1984, 41,762-dwt), the Ma Long Hai (1984, 41,634-dwt), the Ma Quan Hai (1985, 41,634-dwt) and the Ma Shan Hai (1985, 41,634-dwt).
