Bay Ship and Yacht to Perform Maintenance on Balclutha

Bay Ship and Yacht Co. has announced it has once again been honored with the contract to perform maintenance on the historic sailing ship Balclutha. This is the third time the reputable ship yard has been chosen to perform much-needed detailed maintenance on the 131-year-old ship. A three-mast, steel-hulled square-rigged sailing ship, the Balclutha is one of the last of her kind. “The Balclutha is truly a gem of American history. It is a rare day that you are able to see one of these grand old ladies high and dry in dock,” said Richard Maguire, Business Development Manager, Bay Ship & Yacht.

Tuna Vessel Operator Convicted on Pollution Charges

An American tuna fishing company that regularly unloaded its catch in American Samoa, was convicted and sentenced today for discharging oil into the South Pacific and for maintaining false records, announced Assistant Attorney General John C. Cruden of the Department of Justice’s Environment and Natural Resources Division and U.S. Attorney Channing D. Phillips for the District of Columbia. The company, Pacific Breeze Fisheries LLC, owned the Fishing Vessel F/V Pacific Breeze, a tuna purse seiner that was responsible for the pollution. Pacific Breeze Fisheries admitted that its engineers failed to document the illegal dumping of oily bilge water into the waters off American Samoa without the use of required pollution prevention equipment.

Fishing Vessel, Engineer Guilty of Environmental Crime

New Zealand Fishing Company and Chief Engineer Sentenced for Environmental Crimes and Obstruction of Justice. A New Zealand fishing company that owned and operated the tuna fishing vessel San Nikunau, and a former chief engineer on the ship, were sentenced in federal court today for environmental crimes and obstruction of justice, announced Assistant Attorney General Ignacia S. Moreno of the Justice Department’s Environment and Natural Resources Division and U.S. Attorney for the District of Columbia Ronald C. Machen Jr. Sanford Ltd.

U.S. DOJ: Fishing Company Indicted for Enviromental Crimes

New Zealand Fishing Company Indicted for Enviromental Crimes and Obstruction of Justice. A federal grand jury in Washington, D.C., has returned a seven-count indictment charging Sanford Ltd. with violating the Act to Prevent Pollution from Ships (APPS), conspiracy and obstruction of justice, announced Assistant Attorney General Ignacia S. Moreno and United States Attorney Ronald C. Machen Jr. Sanford Ltd. is a New Zealand based company that operates the Fishing Vessel (F/V) San Nikunau, a vessel that routinely delivers tuna to a cannery in American Samoa.

A Success Story: Alaska Ship & Drydock

A new maintenance company with no shipyard experience takes a struggling repair yard, converted from an old cannery, and transforms it into a success story. Alaska Ship & Drydock (ASD) is on its way to achieving its vision of becoming the maritime support center for the North Pacific and Arctic Oceans. Fishing Vessel Master's Violates Primary Duty

In Northern Queen, Inc. v. Kinnear, 2002 WL 1799711 (9th Cir. August 7, 2002), the U.S. Ninth Circuit Court of Appeals held that Blake Kinnear, master (and 22 percent owner) of the F/V LIN J, violated the primary duty rule when the vessel sank in icy waters of the Bering Sea in March 1999, relieving the vessel's owner, Northern Queen, Inc.--77 percent owned by his wife and one percent owned by his minor daughter--of liability for his death. Northern Queen initiated the suit by filing a claim under the Limitation of Liability Act, seeking to limit the vessel owner's liability to the post-casualty value of the vessel together with her pending freight.
