FMC, Transpacific Carriers Settle

Federal Maritime Commission Chairman Steven R. Larson Appointed General Counsel of FMC

Chairman Steven R. Blust announced the appointment of Amy W. Larson as the General Counsel of the Federal Maritime Commission effective January 11, 2004. Mrs. Larson is currently an attorney in the agency's Office of the General Counsel. Mrs. Larson is originally from Milton, Mass., and is a graduate of Wheaton College in Norton, Mass., and Columbus School of Law, Catholic University of America, Washington, D.C. Prior to coming to the Commission, Mrs. Larson had maritime industry experience with a major NVO/freight forwarder. Mrs. Larson joined the Commission in 1993 as an attorney in the Office of the Secretary, with primary responsibility as a Special Dockets Officer, and in 1996, she began working in the Office of the General Counsel. FMC Seeks Comment on China Matter

FMC considered the petitions of three Chinese controlled carriers for relief from the 30-day waiting requirement for reduction of tariff rates of the Controlled Carrier Act (Petition Nos. P3-99, P4-03 and P6-03). As part of its deliberations, the Commission considered letters from the U.S. Maritime Administrator and the Under Secretary of State for Business, Economics and Agricultural Affairs that discuss commitments made in the recently-concluded bilateral Maritime Agreement between the U.S. and the People’s Republic of China. The Administrator and the Under Secretary urge the Commission to favorably consider the Petitions. The Administrator also indicates that he will encourage U.S. carriers and shippers to support them.

FMC Approves NVOCC Service Arrangements Rulemaking

The Federal Maritime Commission announced that it would issue a Final Rule in Docket No. 04-12, Non-Vessel-Operating Common Carrier Service Arrangements, 46 CFR Part 531, to exempt non-vessel-operating common carriers (NVOCCs) from the publication requirements of the Shipping Act of 1984, subject to certain conditions. The Final Rule will allow NVOCCs and their affiliates to offer NVOCC Service Arrangements, or NSAs, to their shipper customers. NVOCCs will now be permitted to agree, on a confidential basis, with their shipper customers on the terms and conditions of service. Cargo moved under NSAs will be exempt from the tariff publication requirements of the Shipping Act. The Final Rule permits NVOCCs acting as carriers to offer NSAs to non-NVOCC shippers.

Hearing on FY2007 Budgets for USCG and FMC

The Subcommittee on Coast Guard and Maritime Transportation of the House Committee on Transportation and Infrastructure conducted a hearing on the US Coast Guard and Federal Maritime Commission FY2007 Budget Requests. Chairman LoBiondo (R-NJ) noted that the budget request would decrease funds available for USCG operations, as compared with the current year. The funding request for the FMC represents an increase of approximately 5.9% over the current year. FMC Announces Seminar Series

Chairman Steven R. Blust announced today that the Federal Maritime Commission is initiating a series of informational seminars to be conducted by the Commission’s Area Representatives and other Commission personnel at various locations around the country. The seminars will provide information to the industry and the shipping public with respect to the Commission’s functions and services as well as instruction regarding the regulatory obligations of providers and users of ocean liner shipping services in the U.S. foreign trades which are administered by the Commission. The seminars will be conducted at a different location on approximately a monthly basis. The first is to take place on Tuesday, February 25, 2003 in Miami, Fla., and the second will be in New Orleans, La., on March 19.
