Subchapter M: Is it Time to Press Pause?

(Photo: Pat Folan)

For many, the path to Subchapter M compliance has been anything but smooth sailing. And while progress has been made through the growing pains, some feel it’s time for the U.S. Coast Guard to pump the brakes.A funny thing happened on the way to compliance. We all learned that nobody was quite ready for Subchapter M.Sure, we had gone through the law with a fine-toothed combed and had self-inspected vessels and trained crews, but we were all surprised by interpretations.Third party organizations (TPO) have done their best to set up systems and satisfy paying customers and the U.S.

Shortage in Supramax

As tonnage in the East Coast South America (ECSA) region continued to outnumber fresh grain requirements, Supramax front-haul freight rates fell this week, reports Platts, quoting shipping sources. The rate for carrying a 50,000 mt grain stem from ECSA to the Far East continued at that level until it fell to $9,500/d plus $95,000 ballast bonus Tuesday. It was $10,000/d plus $100,000 ballast bonus February 27. That fall went against shipbroker and owner expectations in late February that the start of the South Atlantic grain export season in March would lead to a gradual increase in rates. Though grain exports from Argentina and southern Brazil do not normally peak before late April to early May…

Second ranks South Korea’s largest container ship owner Hanjin Shipping with 11 ships, followed by Swiss-based Mediterranean Shipping Company. Does Chapter 11 Work for Foreign Shipping Companies?

Thomas J. Belknap, Partner and Vice Practice Group Leader of Blank Rome’s International and Maritime Litigation/ADR practice group, concentrates his practice in the areas of international commercial and insurance litigation and arbitration, with particular emphasis on the maritime industry.

In the past two or three years, we have seen a wave of shipping companies file Chapter 11 bankruptcy cases in the United States. This latest wave started hitting the street in about 2011 and has included such names as General Maritime, Omega Navigation, Marco Polo, TBS International, B&H, and OSG. The timing is no mystery to anyone who has been following our industry, and I do not think it is too controversial to suggest that what we are seeing now are the continuing effects of the precipitous collapse of freight markets starting in 2008 which…

(Sub) Chapter M Finally Surfaces

For inland operators, Compliance, Safety & Technology make for heavy river traffic as software providers descend on a rapidly approaching, potentially lucrative niche market. Is there a panacea for subchapter M? Pending USCG Subchapter “M” (SubM) regulations will eventually require towing operators to implement safety standards and use safety management systems, or alternatively, allow for an annual Coast Guard inspection regime. The new rules are expected to allow towing vessel organizations to customize their approach to meeting the requirements, while providing oversight using audits, inspections, and reviews of safety data. As many as 5,000 vessels and their operators will eventually feel the impact of the so-called subchapter M rules.
