FMC Penalties and Subsequent Violations
January 28, 2002
The Federal Maritime Commission (FMC) issued an Order providing, among other things, that, when determining civil penalties, the Commission
is without authority to consider subsequent violations by the respondent.
The Shipping Act of 1984, as amended, allows the Commission, when determining civil penalties, to consider 'such other matters as justice may
require', but this does not make subsequent violations relevant to a civil penalty assessment. World Line Shipping, Inc. and Saeid B. Maralan (AKA Sam Bustani)
