FMC Denies NVOCC Service Arrangements Petitions

The Federal Maritime Commission (FMC) issued an Order denying petitions filed by two shippers associations seeking reconsideration of the previous FMC rulemaking exempting non-vessel-operating common carriers (NVOCCs) from tariff publication requirements, conditioned on the filing of confidential service arrangements with the FMC. The FMC also issued Orders (one of which is linked hereto) denying petitions filed by various NVOCCs seeking individual exemptions from the tariff publication requirement. These latter petitions were determined to be moot in light of the recent rulemaking. (HK LAW)
