House Introduces Vessel Discharge Legislation

The American Waterways Operators, a 350-member trade association representing the U.S. tugboat, towboat and barge industry, hailed the House introduction of critical vessel discharge legislation yesterday, praising the leadership of sponsors Duncan Hunter (R-Calif.), Coast Guard and Maritime Transportation Subcommittee Chairman, and Rep. Elijah Cummings (D-Md.), a senior member of the House Transportation & Infrastructure Committee. Bipartisan cosponsors include Reps. AWO Praises Simplification of TWIC Process

Last week, the Transportation Security Administration began nationwide implementation of a program that reforms the burdensome process by which mariners and other transportation workers receive required Transportation Worker Identification Credentials (TWIC). The TWIC OneVisit program eliminates the requirement that workers make two trips to a TWIC enrollment center to pick up and then activate their TWIC. Under the new, streamlined process, a mariner can apply for a TWIC at an enrollment center and opt to receive the credential by mail.

AFL-CIO Affiliate: Port Security Bill has Sensible TWIC Reforms

The House Homeland Security Committee today approved needed reforms to the Transportation Worker Identification Credential (TWIC) program that would eliminate financial and logistical burdens faced by transportation workers under this federal security program. The Transportation Trades Department, AFL-CIO (TTD) supports language in the Securing Maritime Activities through Risk-based Targeting Act, known as the SMART Port Security Act (H.R.4251), which would postpone requiring workers to renew TWIC cards in the absence of Department of Homeland Security (DHS) final regulations mandating biometric card readers. The bill also includes essential reforms to the enrollment, activation, issuance and renewal process.

Bill Introduced To Protect American Maritime Jobs

Working to create and preserve American jobs, Congressmen Elijah E. Cummings (D, MD-7) and Jeff Landry (R, LA-3) today introduced the American Mariners Job Protection Act (H.R. 3202), a bill with bipartisan support that will increase government transparency surrounding the issuance of waivers allowing non-Jones Act-qualified vessels to carry cargo between U.S. ports. Under current law, when the head of the agency responsible for the administration of the Jones Act believes it necessary to waive the Act’s requirements in the interest of national defense, the agency must request the Maritime Administration to assess whether Jones Act-qualified vessels are available to carry the cargo under consideration.

Towing Vessel Inspection Proposal Advances

A bill was introduced in the House of Representatives on April 30 that encompasses the policy provisions of the U.S. Coast Guard’s Fiscal Year (FY) 2005 legislative package, including a proposal that would establish a new inspection program for the towing industry. The bill, entitled the Maritime Transportation Amendments of 2004 (H.R. 4251), was quickly slated for action. On May 6, the Coast Guard and Maritime Transportation Subcommittee of the House Transportation and Infrastructure Committee, chaired by Rep. Frank LoBiondo (R-NJ), convened a hearing on the authorization measure. During his opening remarks, Chairman LoBiondo stated, “Since the establishment of the Coast Guard, one of the Service’s primary duties has been to promote and protect the safety of life and property at sea. Oversight Hearing on TWIC Implementation

The House Committee on Homeland Security conducted an oversight hearing on the Implementation of the TWIC Program. In his prepared remarks, Committee Chair Bennie Thompson (D-MS) expressed his concern that the Transportation Worker Identification Credential (TWIC) program is far behind schedule and that the estimates of the number of workers affected are much understated. Testimony was for the record, as the hearing was interrupted by a floor vote. Hearing on Implementation of the SAFE Port Act

The Subcommittee on Border, Maritime & Global Counterterrorism of the House Committee on Homeland Security conducted an oversight hearing on Implementation of the SAFE Port Act. In his prepared statement, Committee Chair Bennie Thompson (D-MS) noted that the transportation worker identification credential (TWIC) program and the container security device regulations are far behind schedule. Subcommittee Chair Loretta Sanchez (D-CA) expressed her interest in the C-TPAT third party validator pilot program, the empty container security pilot program, long range vessel tracking, and the TWIC program. Ms. Maurine Fanguy, Transportation Security Administration (TSA), discussed recent progress in implementation of the TWIC program.

Hearing – Securing LNG Tankers to Protect the Homeland

The House Homeland Security Committee conducted a hearing entitled Securing LNG Tankers to Protect the Homeland. Chairman Bennie Thompson (D-MS) stated that he was concerned about the significant increase in LNG imports and the increased safety and security risks related thereto. Mr. Jim Wells, Government Accountability Office (GAO), testified that the public safety consequences of a liquefied natural gas spill need clarification. Rear Admiral Brian M.
