USCG Finalizes Inland Navigation Rule Changes

The U.S. Coast Guard (USCG) announced Wednesday the publication of the final rule finalizing changes to the inland navigation rules and their annexes in 33 Code of Federal Regulations parts 83 through 88. This action aligns the Inland Navigation Rules in the Code of Federal Regulations with the amendments made by the International Maritime Organization to the Convention on the International Regulations for Preventing Collisions at Sea, to which the United States is a signatory. Also, the action incorporates recommendations made by the Navigation Safety Advisory Council. The Coast Guard’s Proposed Maritime Preemption Assessment Framework

What it may foretell about the coming towing vessel rule. In the May 2013 issue of Maritime Reporter & Engineering News, Dennis Bryant published a provocative article titled Rebuilding the Presumption of Preemption. The Coast Guard has asserted in the past and believes today that consistent standards of universal application and enforcement, coupled with Federal initiatives to meet unique regional concerns, best meet local and national safety and environmental goals with the least disruption to maritime commerce. 78 Fed. Nav Safety Advisory Council Seeks Applicants

The U.S. Coast Guard is seeking applications for membership on the Navigation Safety Advisory Council (NAVSAC). NAVSAC provides advice and makes recommendations to the Secretary of the Department of Homeland Security on issues related to the prevention of collisions, rammings and groundings, including, but not limited to Inland and International Rules of the Road, navigation regulations and equipment, routing measures, marine information, diving safety and aids to navigation systems. NAVSAC Meets in San Diego

The Coast Guard's Navigation Safety Advisory Council (NAVSAC) met in San Diego, Calif., on December 10-12, 2001. The agenda included a discussion of the National Oceanic & Atmospheric Administration's (NOAA) activities, maritime security challenges, an overview of Coast Guard aids to navigation (ATONs), automatic information systems (AIS), federal and state ballast water and aquatic nuisance initiatives, International Safety Management Code (ISM) implementation and barge lighting and recreational boating incidents. Captain David McFarland, Director of the Office of Coast Survey, NOAA, provided the Council with an overview of NOAA's efforts to conduct surveys of the nation's ports and produce electronic charts and shoreline maps.

Proposed & Interim Rules

EPA is proposing an emission control program for new compression-ignition marine engines rated at or above 37 kW. The affected engines are used for propulsion and auxiliary purposes in a wide variety of marine applications. The standards proposed for these engines would require substantial reductions in oxides of nitrogen and particulate matter emissions to correspond with the next round of emission standards for comparable land-based engines. The proposed standards are expected to provide a significant reduction in oxides of nitrogen and particulate matter from emissions from this source. When combined with other mobile source emission control programs, the program will help provide long-term improvements in air quality in many port cities and other coastal areas.
