SpeedCast Appoints Kagan as COO

Satellite communications and network service provider SpeedCast International Limited has announced the appointment of David Kagan to the position of Chief Operating Officer (COO) reporting to Chief Executive Officer Pierre-Jean Beylier. Kagan comes to SpeedCast from Globalstar, where he served as President and COO. Uniquely qualified as a result of his extensive industry experience, Kagan previously held C-level executive positions at ITC Global, Globe Wireless, Maritime Telecommunications Network (MTN), ICG Satellite Services and Norwegian Cruise Line Ltd. Kagan is expected to start in March 2017, and joins during a key period as integration activities with Harris CapRock accelerate following the completion of the acquisition on January 1, 2017.

Norwegian Cruise to Plead Guilty in Deadly Blast

According to Reuters, Norwegian Cruise Line Ltd. has agreed to plead guilty to a criminal charge of grossly negligent operation of a ship in connection with an explosion that killed eight crewmen on the S.S. Norway in 2003, prosecutors said.  The cruise line will pay a criminal fine, but the amount was not disclosed in a news release from the U.S. Attorney's Office announcing the plea. The company likewise did not disclose the amount of the fine but said it had cooperated fully with government investigators and that the safety of passengers "has been and always will be of the utmost importance." Norwegian Cruise Line is part of the Star Cruises family.

Raising a Red Flag?

A Review of Recent Developments with the Americans with Disabilities Act's Requirements for U.S. By James P. Nader & Rudolph F. Douglas Spector and Tammy Stevens presumably do not know each other, but they have a lot in common. Approximately five years ago, both Spector and Stevens boarded cruise ships out of major ports in the southern United States. Both Spector and Stevens, who are wheel-chair bound, believed their respective cruise ships discriminated against them as disabled passengers. Both individuals filed suit in federal courts alleging violations of the Americans with Disabilities Act. Despite the similarities in their lawsuits, these two federal courts reached completely opposite results.

Supreme Court Hears Arguments in Cruise Ship ADA Case

The U.S. Supreme Court heard oral argument in a case involving whether the Americans with Disabilities Act (ADA) applies to foreign cruise ships that embark passengers at U.S. ports. A decision is expected this summer. Spector v. Norwegian Cruise Line, Ltd., No. 03-1388 (HK Law).

ADA Applies to Foreign Cruise Ships

A sharply divided Supreme Court issued a lengthy and confusing ruling that holds that the Americans with Disabilities Act (ADA) applies to the public spaces on foreign cruise ships calling in U.S. ports. The reader is left to determine why. There is one short opinion that garnered the necessary five votes and holding that the public accommodation and specified public transportation definitions of the ADA include foreign cruise ships. A second opinion (garnering four votes) found that application of the ADA is allowed because it does not interfere with the internal management of the foreign ship. A third opinion (garnering four votes) seems to hold that the ADA provision would only apply if it does require violation of a flag state or international requirement.
