Stolt-Nielsen SA said it plans to file motion to dismiss a grand jury indictment accusing the company of price fixing, as it intends to argue that an amnesty agreement with the Justice Department still holds.
Earlier on Monday, the U.S. Supreme Court refused to consider an appeal by the Norwegian shipping group aimed at blocking the government from pursuing antitrust charges against the company.
In 2004, the Justice Department nullified an earlier leniency deal, which had promised Stolt-Nielsen freedom from indictment in exchange for its cooperation with investigators looking into potential collusion in its parcel tanker and intra-Europe inland barge operations.
