Pentagon threatens to prosecute Senator Mark Kelly if he is recalled to Navy service
After receiving "serious misconduct allegations," the Pentagon threatened on Monday to recall retired Navy Captain Mark Kelly to active duty in order to prosecute.
The statement didn't specify what charges Kelly might face if the organization took this step. Last week, President Donald Trump accused Kelly and Democratic lawmakers of seditious conduct for encouraging U.S. soldiers to refuse illegal orders. In a post on social media, Trump said that the crime is "punishable BY DEATH!"
All service members are reminded of their legal obligations under the UCMJ, (Uniform code of military justice), to obey lawful instructions and that all orders are presumed lawful.
